UnaliWear Kanega Watch Limited Lifetime Consumer Warranty

UnaliWear’s warranty obligations for this hardware product are limited to the terms set forth below:

UnaliWear warrants that the UnaliWear Kanega Watch is free from defects in materials and workmanship under normal use for as long as the consumer remains current in his/her ongoing service payments to UnaliWear (“Warranty Period”). If a hardware defect arises and UnaliWear is made aware of such defect, UnaliWear will replace the watch free of charge, via standard shipping, in as timely a manner as possible. Consumer is required to return the defective watch to UnaliWear within 30 days of receipt of a replacement watch or UnaliWear will charge Consumer $399 for a non-returned watch.

EXCLUSIONS AND LIMITATIONS
UnaliWear does not warrant that the operation of the Kanega Watch will be uninterrupted or error-free. UnaliWear is not responsible for damage arising from failure to follow instructions relating to the Kanega Watch’s use; including, but not limited to, submerging the Kanega Watch in water and/or changing the batteries in ways different from the instructions provided by UnaliWear. (Instructions are provided in video form on UnaliWear’s web site and in the instruction card included in the Kanega Watch kit box, among other means.)

UnaliWear does not warrant that a Consumer cannot break the watch.  If a Consumer breaks the Kanega Watch during the Warranty Period, UnaliWear’s replacement policy is as follows:

  1. First breakage – free replacement and, under certain circumstances, free standard shipping
  2. Additional breakage – $199 broken watch fee and Consumer pays $50 for standard shipping charges

 

This Warranty does not apply: (a) to devices used for commercial purposes; (b) to damage caused by use with non-UnaliWear products; (c) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (d) to damage caused by operating the Kanega Watch outside the permitted or intended uses described by UnaliWear; (e) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of UnaliWear; (f) to a product or part that has been modified to alter functionality or capability without the written permission of UnaliWear; (g) to consumable parts (excluding batteries), unless damage has occurred due to a defect in materials or workmanship; (h) to cosmetic damage or defects or damage caused by normal wear and tear, including but not limited to scratches, dents and broken plastic; (i) usage or storage in unsuitable physical or operating environments; or (j) if any UnaliWear serial number or labeling has been removed or defaced.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. UNALIWEAR’S RESPONSIBILITY FOR HARDWARE DEFECTS IS LIMITED TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY UNALIWEAR IN ITS SOLE DISCRETION. NO WARRANTIES WILL APPLY AFTER THE EXPIRATION OF THE LIMITED WARRANTY PERIOD. UNALIWEAR SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND OF NON-INFRINGEMENT.
The remedies provided by this Limited Warranty are Consumer’s sole and exclusive warranty remedies. No agent, employee, or representative of UnaliWear or any other person is authorized to modify this warranty in any respect. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE EXTENT REQUIRED BY LAW, UNALIWEAR IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF ACTUAL OR ANTICIPATED PROFITS; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE KANEGA WATCH. THE FOREGOING LIMITATION SHALL NOT OPERATE TO LIMIT UNALIWEAR’S LIABILITY FOR DEATH OR PERSONAL INJURY CLAIMS IN CONTRAVENTION OF LAWS PROHIBITING SUCH DISCLAIMERS.
SERVICE RETURN
To obtain service under the Limited Lifetime Warranty, the Consumer must notify UnaliWear of any defects. The Consumer shall be responsible for the safe transport of the equipment to UnaliWear. To prevent damage to the Kanega Watch or accidental activation, UnaliWear may provide specific return packaging and shipping instructions for warranty return. If instructions are provided, the Consumer is responsible to pack and ship the Kanega Watch in this specific manner. The Consumer shall not ship the Kanega Watch back to UnaliWear without first calling UnaliWear at (888) 343-1513 to obtain warranty return authorization and/or advise of the Consumer’s intent to do so. Consumer shall retain responsibility for any loss or damage to equipment until the equipment is received by UnaliWear. Equipment should be mailed to the address below, or to such other address as UnaliWear may designate from time to time:
